Terms of Use

The short version

Product Listing Studio is a one-time purchase Mac App Store app sold under Apple’s Standard End User License Agreement. It collects no data, has no subscription, and comes with no warranty beyond what Apple provides. Refunds go through Apple.

About These Terms

These Terms of Use govern your use of Product Listing Studio (the “App”), a macOS application provided by Tyler Bosch (“we,” “us”). By downloading, installing, or using the App, you agree to these Terms and to Apple’s Standard End User License Agreement, which governs all apps distributed through the Mac App Store.

License

The App is licensed, not sold, to you. Your license is granted by Apple under the Standard End User License Agreement (the “EULA”) accompanying every Mac App Store purchase. You can read it at apple.com/legal/internet-services/itunes/dev/stdeula. The EULA grants you a personal, non-transferable license to use the App on any Apple-branded device that you own or control.

One-Time Purchase and In-App Purchases

The App is a free download. The free version saves up to 3 photos. To unlock unlimited photo saves and JPEG quality control, the App offers a single non-consumable in-app purchase (“Unlock Full Version”) for $7.99 USD or the local equivalent. This is a one-time purchase, not a subscription. Once unlocked, the full version is yours on every Mac signed into the same Apple Account.

Refunds

All purchases are processed by Apple. Refund requests are handled through Apple, not through us. To request a refund, visit reportaproblem.apple.com or follow the steps at support.apple.com/HT204084. Apple’s standard refund policies apply.

Restoring a Previous Purchase

If you previously unlocked the App and installed it on a new Mac, or reinstalled it on the same Mac, you can restore your purchase from within the App. Restoring is free and uses your existing Apple Account — no additional charge.

Acceptable Use

The App is provided for personal and commercial use in capturing product photographs. You agree not to:

· reverse-engineer, decompile, or disassemble the App except as expressly permitted by applicable law;
· redistribute, sublicense, sell, or rent the App to any third party;
· use the App in any way that violates Apple’s Mac App Store terms, applicable law, or the rights of others.

Privacy

The App collects no personal data, has no analytics, and makes no network requests. Your captured photos remain on your Mac in the folder you choose. Full details are in our Privacy Policy.

No Warranty

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, except as required by applicable law. Your statutory consumer rights are not affected by this section.

Limitation of Liability

To the maximum extent permitted by law, neither we nor Apple are liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App. Where liability cannot lawfully be excluded, our aggregate liability is limited to the amount you paid for the App.

Apple as Third-Party Beneficiary

You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms. Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Updates and Changes

The App may receive updates through the Mac App Store. These updates may add, modify, or remove features. If we materially change these Terms, the updated version will be posted at this URL with a new effective date. Continued use of the App after a change indicates acceptance of the updated Terms.

Termination

You may stop using the App at any time by uninstalling it. We may terminate or suspend access if you materially violate these Terms or applicable law. Sections covering Limitation of Liability, No Warranty, and Apple as Third-Party Beneficiary survive termination.

Governing Law

These Terms are governed by the laws of the State of Washington, United States, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in King County, Washington, except where applicable consumer protection law in your jurisdiction grants you the right to bring an action elsewhere.
